Terms of Service
Effective 7 June 2026
These terms are an agreement between you and bdayvillage (“bdayvillage”, “we”, “us”). By using bdayvillage you agree to them. If you do not agree, please do not use the service.
The service
bdayvillage helps parents and guardians plan children’s birthday parties — creating events, collecting RSVPs, and coordinating optional gifts, help, and contributions. Guests can respond to an invitation link without creating an account.
Your account
You must be at least 18 and a parent, guardian, or other responsible adult to create an account. You are responsible for the information you enter, including any details about children and guests, and for having a reasonable basis to share it. Keep your login secure.
Premium
bdayvillage is free to start. Premium is a one-time purchase of A$18 that unlocks the Party Assistant AI actions, larger gift and help lists, larger guest lists, and a fuller activity history. Prices and exact allowances are shown at checkout and may change for future purchases.
Refunds
Premium unlocks digital features immediately, so we do not offer refunds for change of mind.
This does not affect your rights under the Australian Consumer Law. Our services come with consumer guarantees that cannot be excluded. If Premium is faulty, not as described, or otherwise fails a consumer guarantee, you are entitled to a remedy — contact hello@bdayvillage.com and we will make it right, including a refund where the law requires.
Contributions & chip-ins are between you and your guests
bdayvillage does notprocess gifts, group contributions, or “chip-ins”. When guests contribute, they pay each other directly through external apps (for example PayPal, Venmo, or Cash App). No money for gifts or contributions flows through bdayvillage, and we are not a party to, and not responsible for, those payments.
Acceptable use
- Use bdayvillage only for lawful, personal party-planning purposes.
- Do not upload unlawful, harmful, or infringing content, or other people’s data without a proper basis.
- Do not attempt to disrupt, probe, or abuse the service or its providers.
- Use bdayvillage within reasonable limits. To keep the service stable and fair for everyone, we apply per-account limits on how much content can be created (for example, the number of parties and saved events), and we may adjust these limits or restrict accounts that appear to be automated or abusive.
Allergy and safety information
Allergy and dietary notes are provided by users for convenience and coordination. They are not medical advice and may be incomplete. Always confirm critical health and allergy details directly with the relevant parent or guardian.
Disclaimers and liability
Nothing in these terms excludes, restricts, or modifies any consumer guarantee, right, or remedy you have under the Australian Consumer Law that cannot be excluded.
Otherwise, and to the extent permitted by law: the service is provided “as is” and “as available”; AI-generated suggestions are optional aids that may be inaccurate, so use your own judgement; and our liability for any matter not covered by a non-excludable guarantee is limited, at our option, to re-supplying the service or refunding the amount you paid us. We are not liable for indirect or consequential loss.
Termination
You may stop using bdayvillage and delete your account at any time. We may suspend or end access if these terms are breached or to protect the service or its users.
Governing law
These terms are governed by the laws of Queensland, Australia, and you and we submit to the courts of Queensland and the Commonwealth of Australia.
Changes
We may update these terms; we will update the effective date above when we do.
